Know Your Rights After an Accident

1. You have the right to choose a collision center after the accident
You do not have to use your insurance company’s “direct repair programs” or “preferred shops”. Insurance companies are prohibited by law to interfere with your choice of auto repair facility. You should choose the collision repair shop that makes your needs a priority and makes you feel confident that your repairs will be done right.
2. You have the right to first hand parts
Without written consent from you, your insurance company cannot authorize the use of aftermarket parts for your vehicle repair. You have the right to the best quality vehicle repair available.
3. You have the right to choose a car rental agency
If the accident is not your fault, the other party’s insurance company is responsible for allowing you a rental vehicle comparable to your own while your car is being repaired. You are free to choose any car rental agency and should not be made to pay for your rental car if rentals are a part of your insurance coverage.
4. You have the right to choose what you want to pay for repairs
Your insurance company is has no control over the prices charged by a licensed independent or dealership franchised auto repair facility. You have the right to pursue as many estimates as you’d like, but you are not legally required to obtain more than one.
5. You have the right to authorize all vehicle repairs
Your insurance company cannot authorize repairs to your vehicle without your consent. You alone, as the owner of the vehicle, have the authority to permit auto repairs.
6. You have the right to a fair price
If your car is totaled, you are entitled to the market value of your vehicle at the time of your accident. While this amount may be higher or lower depending on vehicle condition, any loan payoff amounts should not affect the value of your car.
7. You have the right to ask questions
Collision repair quotes differ at each auto repair shop. A cheaper quote may not include all repairs or may use second hand parts. You have the right to be informed of all repair details and make a decision on a collision shop that will get you back on the road safely.
